EB 5 Investment via Regional Center
The EB 5 Visa program grants the potential for a green card and eligibility for citizenship to those who make an investment of at least $1 million in a project that creates or preserves at least 10 jobs in theUnited States. The applicant does have an alternative however, named the EB 5 Regional Center Program. This option is particularly popular among the Chinese which make up an overwhelming majority of all EB 5 applications worldwide.
The Regional Center Program requires an investment of $500,000 USD in a targeted employment area, which is either in a rural or high unemployment area of the United States. There are some additional guidelines to the EB-5 Regional Center Program which are as follows:
- Foreign investment into the Regional Center Program must be made prior to submission of the EB 5 application. This is vital for obtaining approval of the petition which shows that the invested funds were legally earned.
- All investment ventures are managed by various General Partnerships, which are authorized to sell Limited Partnerships in the program to foreign investors who wish to pursue permanent residency with a “Green Card” in the United States.
- The program requires the investment to create 10 full-time positions, unlike the regular EB 5 program that requires the investment to create a minimum of 10 “direct” jobs for U.S. Citizens, the Pilot Program simply requires that a minimum of 10 direct or indirect full time jobs for U.S. citizens be created as a result of the investment which makes this program more attractive and popular among foreign investors.
The EB 5 Regional Center Program is particularly appealing for the real estate market. Several real estate developers around the country are utilizing the opportunity to have direct access to foreign investors in order to get capital-starved projects up and running. The EB 5 Regional Center serves as an intermediary between local developing projects and foreign investors. As long as this partnership creates 10 jobs per $1 million dollar investment, then the temporary visa turns into a permanent one. In some cases, this program can cover up to 70 percent of a project depending on the amount of jobs created. Every month, more regional centers are opening around the country to provide initiative to foreign investors. Even though this program has been around for well over a decade, it has never been more successful or attractive given the current state of the real estate market.
