EB-5 Policy Change and Opportunity
EB-5 visa applications have been on the slight rise in the United States for the past year, but for reasons unknown. The fact is, it has been extremely difficult for foreign investors to follow through with their goal of investing $1 million ($500 thousand if in a low-employment area) into a business that creates jobs, due to bureaucratic boundaries. However, in a shroud of luck, an immigration policy concerning EB-5 visas has been has been modified, changing everything.
Previously, the general solicitation or general advertising for EB-5 Regional Centers was banned. Regional Centers are economic entities, both public and private, that are involved with the promotion of economic growth, improved regional productivity, job creation and increased domestic capital investment. Recently, this ban was lifted by the Securities and Exchange Commission, as part of the (JOBS) act put into play by President Obama. This new rule is expected to positively impact EB-5 investment practices by granting Regional Centers far more freedom to generally solicit and advertise under certain terms and conditions, as long as all purchasers in the offering are accredited and certified investors. The ruling allows Regional Centers to advertise projects via website advertisements, newspapers, radio, internet posts, and email.
